Laws and Regulations
International Legal Framework
- Articles VI, XVI, and XIX of the General Agreement on Tariffs and Trade (GATT)
- Trade Remedies Agreements under the World Trade Organization
These agreements comprise three principal WTO Agreements that regulate and define the methods and procedures for protection against unfair trade practices in international trade, namely: the Anti-Dumping Agreement, the Agreement on Subsidies and Countervailing Measures, and the Agreement on Safeguards. Together, these agreements constitute the sole internationally recognized legal framework for the protection of domestic industry within the WTO system, through addressing dumping practices, subsidization, or sudden and significant increases in imports, where such practices are found to cause serious injury to the domestic industry.
National Legal Framework (Egypt)
- Law No. 161 of 1998
- Ministerial Decree No. 549 of 1998 (issuing the Executive Regulations of Law No. 161 of 1998, as amended)
Law No. 161 of 1998, together with its Executive Regulations and subsequent amendments, governs the procedures and legal framework applicable to the protection of the national economy from the adverse effects of unfair trade practices in international trade. This is achieved through the application of anti-dumping, countervailing, and safeguard measures, in full conformity with the obligations of the Arab Republic of Egypt under the WTO Agreements. (issuing the Executive Regulations of Law No. 161 of 1998, as amended) The Law and its Executive Regulations establish a comprehensive legal framework setting out the substantive rules and detailed procedures governing the conduct of investigations and the adoption of trade remedy measures, in a manner that ensures transparency, respect for the rights of defense of all interested parties, and an appropriate balance between compliance with international obligations and the protection of domestic industry.
Drafting and proposing legislation and regulatory amendments, and participating in the formulation of negotiating positions and the submission of proposals related to trade remedies within the framework of multilateral trade agreements, in a manner consistent with national interests.
